Allegations:

Gaye was at home celebrating his birthday and Thanksgiving with friends and family when officers arrived around 1:00 a.m. and told everyone to leave. Gaye told officers several of his guests were planning on spending the night in his home but officers insisted everyone, including Gaye, leave his home. Officers then arrested Gaye. Two guests tried to record the officers throwing Gaye against a table, car and fence but were also arrested. Gaye was charged with reckless conduct and officers filed false reports alleging he had broken bottles, flailed his arms and tried to pull away from them while he was being handcuffed. Officers also punched and kicked Gaye, who was still in handcuffs, as they escorted him into the police station. While in custody Gaye received treatment for his injuries at St. Francis Hospital.
