Allegations:

Officer Hoyas prepared a search warrant for a second-floor unit of an apartment building. The building listed had two units on the second floor: one in the front, one in the rear. Two days later, at 8 a.m., several officers executed the warrant and searched the front apartment without finding any weapons, narcotics or other contraband. As the officers were leaving the building, they saw a door that led to the rear apartment. With their guns drawn, the officers forced their way into the second-floor rear apartment where Chilcutt and Otero were sleeping. Without a warrant, the officers searched Chilcutt and Otero's apartment and found one gram of marijuana, worth about $5. The officers charged Otero with illegal possession of cannabis. About two months later, the charges against Otero were dismissed.
