Case 16-CV-8149

$1,500

FALSE ARREST

Traffic stop On duty Excessive force Racial epithets False arrest or report Drug charges

Plaintiff: Byron Greene

Incident date: 05/04/2016

Location: 442 West 97th St.

Allegations:

Greene was in his car parked in front of his home and talking on the phone when three officers in an unmarked police SUV pulled over next to him. The officers parked so close to Greene's car that their driver's door was completely blocking his driver's door. Greene rolled down his window to ask why they had stopped. The driver of the police vehicle called him a "smart ass nigger" and began backing up so another officer could pull Greene out of the car. Greene placed his hands on the front of SUV while the officer who had been driving began searching and removing items from his pockets. Meanwhile, the other officers searched Greene's car and trunk. The officers ran Greene's license, which they said was suspended, and discussed who was going to drive his car. Greene asked the officers to give his personal items to his niece, who was in front of the house; they allowed it after making more derogatory remarks about black people. The officers drove Greene to the police station and filed a false report stating that they had found drugs in his car. Greene was released on bond, but was unable to go to work because his car had been impounded.

No officers were named in this case.
