Case 16-CV-371

$120,000

REVERSED CONVICTION

Home invasion On duty False arrest or report Gun Weapons charges

Plaintiff: Halderon Murphy

Incident date: 06/12/2010

Location: 6735 South Clyde Ave.

Allegations:

Murphy was visiting a friend when Sgt. McInerney and Officer Hayes arrived. The officers announced that they had an arrest warrant for another man, entered the apartment with their guns drawn, and ordered Murphy, his friend, and her children to sit on the floor. During the search, Officer Hayes found a gun in a purse in the closet, which Murphy's friend said belonged to her mother. The officers arrested Murphy and charged him with armed habitual criminal and unlawful use of a weapon by a felon. Officer Hayes falsely testified at trial that Murphy had said the gun was his. Murphy was found guilty of the charges and was sentenced to six-and-a-half years in prison. He appealed and his conviction was overturned. He ultimately spent three years and seven months in prison on the false charges.
