Tolbert Jones and his grandson Colin Craybeek live in the garden level of a three-floor apartment on Chicago's North Side. Onzell Hale Washington lives with her son Jerome Hale and grandson Dejong Montgomery on the main floor. All of the plaintiffs heard a loud banging at the building's front door. Sergeant Dakuras and Officer Diblich broke down the door and stormed into the home with guns drawn. Jones, who is a security guard and licensed to carry a gun, put his gun on his bed out of fear of the officers. Dakuras and Diblich walked through the apartment's main floor and garden level pointing their guns at all of the plaintiffs before finding Jones' gun on his bed. Dakuras and Diblich took the gun and arrested Jerome Hale, seizing $400 from Montgomery and $900 from Hale. They put the gun and the money in a bag they found in a closet. Dakuras and Diblich then took Hale to a police station, where Hale was asked to provide information about drug dealers in the area. About 30 minutes after leaving the home, Dakuras and Diblich returned with guns drawn to retrieve the bag with the gun and the money. When Dakuras and Diblich asked where the gun was, Montgomery replied that Jones had taken the gun and left the house. Dakuras and Diblich grabbed Montgomery, yanked his arm, took him to their squad car and threatened to arrest him if Jones did not return and give them the gun. One of the plaintiffs called Jones, who returned and gave his gun to Dakuras and Diblich. When Jones asked how he could get his gun back, Dakuras replied, “You're never getting your f**king gun back.” Hale was eventually released from the police station. The gun and the money were never returned.
