Allegations:

Montano was driving his car when Officer Wallace pulled him over, handcuffed him and falsely accused him of possessing illegal drugs. After searching Montano's car, Wallace arrested him, even though he did not find any illegal drugs in the vehicle. On the way to the police station, Montano told Wallace he was diabetic and needed to get his insulin out of his car. Montano continued to request his insulin after they arrived at the station and told Wallace he was getting sick. Wallace moved Montano to a different room and handcuffed him to a pole. Two hours later, Montano began screaming for help and told two officers, including Wallace, that he was having a “diabetic attack.” Though the officers ignored Montano and tried to continue processing him, a supervisor entered the room and told the officers to call an ambulance. Montano was then taken to the hospital and diagnosed with diabetic ketoacidosis. He stayed in the intensive care unit until the following afternoon. Montano was charged with possession of cannabis, but the charge was terminated two months later.
