Allegations:
Leroy Hubbard was walking home when Officers Rake, Mackowiak and Swiatkowski pulled up next to him in an unmarked SUV. Rake ordered Hubbard to walk toward the officers' car, but Hubbard ignored him and continued walking home. The officers followed Hubbard home in the SUV. Hubbard entered his home, and Rake followed him in without a warrant or consent. Once inside, Rake grabbed Hubbard by the jacket and pushed him against the wall, kicking him in the legs. Mackowiak and Swiatkowski entered the home, and within minutes, Officers Serrano, Blackman and others arrived as well. Rake and Mackowiak pushed Hubbard's face against the wall, choked him and put him in handcuffs. Leroy Hubbard's mother, Anita Hubbard, 55, was hooked up to a dialysis machine in the home when the officers entered. One of the officers pushed Anita Hubbard to the ground, nearly causing her dialysis machine to disconnect from her body. Hubbard's cousin, K.H., 14, began recording the incident on her iPad, and one of the officers told her to stop recording, pulled her hair and tried to take her iPad. The officers took Hubbard outside to an SUV, searched him and found a pocket knife in his pocket. Rake charged Hubbard with battery to a police officer, resisting arrest and sale or possession of a deadly weapon. The charges against him were dismissed nine months later.
