Case 15-CV-8766

$20,000

FALSE ARREST

Traffic stop On duty Threats/intimidation Excessive force False arrest or report Resisting or obstructing arrest charges Other charges filed Drug charges

Plaintiff: Eddie Freeman

Incident date: 10/05/2013

Location: 40 W 71st St.

Allegations:

Eddie Freeman and his wife, Yvonne Freeman, were in the car with their two children heading to a restaurant when the officers began following their car with their headlights off. The officers pulled over the Freemans and ran the license plate of their car. As they were doing this, the officers were notified about an investigative alert that had been issued for a person named Eddie Freeman. The officers ordered Yvonne out of the car so they could search her, and then ordered the children to get out and put their hands on the car. Eddie Freeman was the last one ordered out of the car. The officers did not give Freeman any answers when he asked why his family had been stopped, and aggressively grabbed his arms and neck after seeing a phone in his hand. The officers promised not to arrest anyone if Freeman and Yvonne signed a statement admitting to marijuana possession, but they refused to sign it. The officers took the couple to the police station, leaving the children at the traffic stop. Their car was impounded. Freeman was charged with a felony for obstruction of justice and resisting arrest, and Yvonne was charged with possession of cannabis and two traffic offenses. The charges against Yvonne were dropped, but Freeman had to retain an attorney to defend him against the charges. A jury later found him not guilty.
