Case 15-CV-5147

$80,000

FALSE ARREST

On duty False arrest or report Other charges filed

Plaintiff: David Diaz

Incident date: 01/03/2014

Location: 5815 S Pulaski Rd

Allegations:

Diaz was standing at a bus stop when officers investigating an attempted burglary nearby arrested him. A 12-year-old witness had told officers that she saw two men wearing all black with black backpacks. Diaz was wearing blue jeans, white sneakers and a black coat, and had a gold and black backpack. Officers manipulated the 12-year-old, telling her they were showing her a man who may have been one of the attempted burglars before bringing in Diaz. Later, officers falsified paperwork to make it appear that the witness had specified that the attempted burglars were two "Hispanic males." Based on the 12-year-old's identification, Diaz was arrested and spent over a year in jail awaiting trial before he was acquitted of all charges.
