Allegations:

R.S. was walking home on a summer night with friends when Officer Acevedo and his partner approached the group in a well-lit alley they used as a shortcut to R.S.'s house. Acevedo questioned the friends, and they complied. The officer began shouting at R.S. when he did not produce his identification quickly enough. R.S. revealed that he did not have identification on him. Acevedo continued to shout at R.S., threatening, “Without an ID, we wouldn't be able to identify your body if you turn up dead in the street.” Alarmed at the comment, R.S. attempted to get away from the officer by running down the alley. Acevedo returned to his car and pursued R.S., while his partner chased R.S. on foot. R.S. then ran into a fence and began to climb it when Acevedo got out of his car and drew his gun. R.S. fell to the ground and faced the officer. Acevedo shot at R.S. three times, hitting him once in the arm and once in the thigh. The officer told R.S. to “shut the f**k up” as he lay injured on the ground. Acevedo gave false statements to other officers as they arrived at the scene, telling them R.S. was about to strike him with a wooden board so he shot in fear. Acevedo lied about the shooting in subsequent interviews with investigators, other police personnel and the Independent Police Review Authority.
