Allegations:
Spencer had just exited his car when Officer Connolly approached and began searching him. Connolly removed a key fob from Spencer's pocket without his consent and walked near several parked vehicles, pointing and pressing the key at each one, until he found Spencer's car. Connolly searched the car and pressed Spencer about hiding drugs, which Spencer denied. The officer removed from the vehicle Spencer's cell phone, keys, watch, half-carat diamond stud earrings, and roughly $120 in cash. Spencer was arrested and charged with delivery and possession of a controlled substance within 1,000 feet of a school. After his release, Spencer received all of the stolen items except the diamond earrings. Approximately a month and a half later, officer Connolly testified falsely at a preliminary hearing while Spencer was present, but the charges against Spencer were dropped. Officer Connolly told Spencer after leaving the court room, "I'll be back to get you."
