Allegations:
D.W., a minor, and his friend were arrested on suspicion of loitering outside a gas station. They were handcuffed together and taken to a police station. As he waited to be booked, D.W. asked what song was playing on the radio. Officer Underwood responded, “Shut the f**k up” or he would “smack the s**t out of” D.W.. D.W. then looked at Underwood's name tag. Underwood responded, “Yeah, look at my name tag and see who smacks the f**k out of you.” After Officer Kinard fingerprinted D.W., Underwood picked him up, carried him into a holding cell and forcibly slammed him headfirst onto the concrete floor. Kinard then told D.W. to “get off my f**king floor,” and D.W. was led to another room, where Officer Pellonari told D.W. he “would have to charge [D.W.] with something so the officers would not get in trouble.” D.W. was then charged with aggravated battery and aggravated assault. He was re-processed and taken to a hospital by ambulance to be treated for his injuries. D.W. was held in custody for an additional 24 hours before being released. He had to appear in court several times with his mother and attorney. Officers Solski and Ratler serve as witnesses in support of the false charges against D.W., which were eventually dismissed.
