Case 15-CV-240

$25,000

ILLEGAL SEARCH/SEIZURE

Home invasion On duty Elderly Damage to property Illegal search/seizure

Plaintiff: Johnie M. Winston

Incident date: 07/22/2014

Location: 1308 N. Lockwood Ave.

Allegations:

Winston, 68, lives in a second-floor apartment and works as a maid. Chapman, 62, lives on the first floor with her husband. Ivory, 44, lives in the basement apartment. Winston was carrying in groceries with help from Ivory when police officers arrived at their building in squad cars. Without consent or a warrant, officers kicked in the building's front door and entered the building while other officers broke into a rear door. When Winston and Ivory tried to go inside to see what the officers were doing, they were ordered to stay outside with some of the officers. Chapman was inside her home when officers entered to search, looking through her closets and drawers. Officers removed clothing from Ivory's closets, turned his mattress upside down and opened drawers and cabinets. The officers failed to find any illegal items. Sergeant Talley told Winston to call 311 to have the city pay for the damage to their front door, and the officers drove away.
