Allegations:
Giljen was returning home with his wife and children around 5:30 p.m. At a Red Line station, his wife used her Ventra card to pay for her fare, and then passed through the handicap gate because she had a toddler in a stroller. Giljen used his Ventra card twice, to pay for himself and his 9-year-old son. When Giljen joined his family in the station, a police officer approached him and accused Giljen of not paying his fare. The officer took Giljen's Ventra card and tapped it at another turnstile, deducting an additional fare from the card's balance. Giljen offered to log into his Ventra account and his bank account to prove he had already paid and asked the officer to speak with a Chicago Transit Authority (CTA) employee to verify Giljen's payment. Another officer arrived, and the officers grabbed Giljen's arm and told him he was under arrest. The officers threatened to throw Giljen to the ground, handcuffed him and took him to a room at the station, where they searched him. One of the officers took Giljen's identification and Ventra card and spoke with a CTA employee. The officer took Giljen to a police station, where he was searched again. Giljen was handcuffed in lockup for several hours before he was released. Giljen was charged with theft of labor/services/property. The criminal case was dismissed.
