Case 14-CV-9577

$100,000

EXCESSIVE FORCE/SERIOUS

On duty Elderly Excessive force Shooting Physical force Gun Assault or battery to an officer charges Hospitalized

Plaintiff: Hazel Jones-Huff

Incident date: 04/25/2014

Location: 8411 S. Carpenter St.

Allegations:

Jones-Huff was in the backyard of her home in the Auburn Gresham neighborhood when she noticed a neighbor's flower pot was leaning on her fence. Her neighbors were Officer Hill and his wife. Jones-Huff pushed the pot off the fence with a stick, and Hill's wife ran out of her home yelling obscenities at Jones-Huff. Hill's wife then tossed dirt over the fence onto Jones-Huff's head. Police were called to the scene, and shortly before they arrived, Jones-Huff's husband went inside their home and returned with a shotgun. He shot Hill's wife once in the arm. Hill, then off-duty, shot Jones-Huff's husband nine times, killing him. Jones-Huff tried to get to her husband, but Hill turned his gun on her and shot her twice. Jones-Huff was taken to the hospital for her injuries. Hill attempted to charge the 91-year-old woman with aggravated assault to a police officer and battery, claiming that the 5-foot Jones-Huff had reached over the 6-foot fence to strike him and his wife on the head with a broom. Jones-Huff was found not guilty.
