$10,000

EXCESSIVE FORCE/SERIOUS

Stop and frisk Off duty Excessive force Pepper spray Physical force Assault or battery to an officer charges Hospitalized Resisting or obstructing arrest charges

Plaintiff: Stephonald Whittington

Incident date: 08/07/2013

Location: 400 N. State St.

Allegations:

Whittington was sitting on the steps of a building with a friend with a drink in his hand, when Officer Maras approached them. Maras was not in uniform and didn't show them his badge. He grabbed Whittington's drink and threw it under a car, then aggressively grabbed, pushed and beat him. Whittington told Maras he had recently had surgery and couldn't move his arm without pain, but Maras ignored him, unnecessarily pepper sprayed him and threw him to the ground, where he continued to push and kick him. Maras arrested Whittington and charged him with aggravated assault and resisting arrest. An ambulance took Whittington to the hospital for his injuries. The charges against him were later dismissed.
