Allegations:
Xie, a business owner, received a call from an employee saying a package was being delivered to his business that needed to be unloaded with a forklift. Xie approached a delivery truck outside his business on a forklift. Two undercover officers, dressed as deliverymen, approached him. One of the officers gave him a paper to sign, but Xie, a native of China who is unable to read or speak English, could not understand them. However, the officers gestured to Xie, and he wrote something on the paper. Other officers arrived, approaching Xie from behind with their guns drawn. The officers pulled Xie off the forklift and threw him to the ground. Xie was arrested and charged with felony possession of cannabis. Unknown officers searched his business, opening a desk drawer and sifting through an employee's purse and wallet. Officers Romero and Forgue stated in a police report that they gave Xie verbal instruction to get off the forklift, but he did not comply. Seven months later, Romero stated in a supplementary report that Xie had told him and Officers Moore and Salgado that Xie had been paid $1,500 to receive packages, despite the fact Xie did not speak English and the officers spoke no Chinese. A year and three months after the incident, the drug charge against Xie was dismissed.
