Case 14-CV-3046

$10,000

FALSE ARREST

On duty Destroy/conceal/fabricate evidence False arrest or report Weapons charges Drug charges

Plaintiff: Marcus Cunningham

Incident date: 04/17/2014

Location: 7356 South Halsted St.

Allegations:

Officer Cooper executed a search warrant for a store where Cunningham worked. During the search, the officers found a Glock model 23.40 caliber handgun, a box of live rounds of 0.32 caliber bullets, and a tin can containing 20 small plastic bags filled with what appeared to be cannabis. Cunningham told the officers he possessed a Firearm Owner's Identification card. However, the officers omitted these details from the police report. They arrested and charged him with a misdemeanor unlawful carry/possession of a firearm and possession of cannabis. The next day, Cunningham posted bond and was released from jail while awaiting trial. Cooper and Schmitz arrested him again five days later after pursuing felony review for the previous alleged violations. Cunningham, who had never been arrested or convicted of a felony, had been interviewing for jobs, but was not offered employment as a result of the felony arrest.
