Plaintiff:
Ricardo Aguilar
Incident date:
04/21/2011
Location:
5251 S. Kostner Ave.
Allegations:
Alfonso and Patricia Cavada and their son, Ricardo Aguilar, were at home in the Archer Heights neighborhood when officers arrived and demanded entry. The officers would not show Aguilar a warrant, so he denied their entry. The officers grabbed him and threw him against the exterior fence of the property. As Patricia Cavada approached the doorway, the officers threw her to the ground and handcuffed her while one of the officers rested a knee on her back and held a firearm to her head. They lifted her from the ground and threw her against the exterior of the residence. At this time, Patricia was recovering from surgery related to the birth of a child. The officers wrestled Alfonso Cavada from his residence and slammed him against a vehicle. When Alfonso Cavada asked the officers why they were assaulting him and his family, they responded by showing him a picture of his son holding a firearm. Alfonso Cavada told the officers the image had not been taken at the residence since the door in the photograph did not resemble those in his home. Officers then attempted to clean the blood spatter from their use of force against the family, and both Alfonso and Patricia Cavada were taken to the hospital for treatment.
