Case 12-CV-9207

$10,000

FALSE ARREST

On duty False arrest or report Weapons charges

Plaintiff: Noble Richard Martin

Incident date: 11/22/2010

Location: 8100 S. Hermitage Ave.

Allegations:

Martin was outside a residence with his ex-wife when Officers Torres and Leonard arrived. The officers placed Martin into their police car and talked to his ex-wife, who gave them a gun she said her daughter had found in a dresser drawer. Martin denied the gun was his, yet the officers took him to the police station and charged him with failure to possess a FOID card. Leonard went back to the residence to get the ex-wife to sign a complaint for domestic battery, and then returned to the station. The officers filed false reports against Martin, claiming they had recovered the gun from a bedroom drawer. The charges against Martin were dismissed almost three years later.
