Plaintiff:
Eligio Torres, Jr.
Incident date:
10/01/2010
Location:
3225 West Pierce Ave.
Allegations:
Torres and Correa were at a friend's house making tamales when Torres left at 10:30 p.m. to pick up his son. Torres had parked his car in an outdoor carport about a block away, and was backing out his car when Officer Pena and another officer approached him. The officers, who were in plainclothes, opened the car doors and grabbed Torres, who thought he was being robbed. Correa heard Torres screaming for help and ran toward the carport, also thinking that the officers were robbing him. Correa ran in from behind and pushed Pena, who then punched her in the face. Another officer arrived at the scene and tased Torres when he attempted to help Correa. Torres fell to the ground and was tased again a few minutes later. Torres and Correa were taken to the hospital and charged with battery to a police officer. They were found not guilty nearly two years later.
