Allegations:

Bartl hailed a cab to go from a church on the Near North Side to a movie theater in Cicero. Instead of driving Bartl to his requested destination, the cab driver took him to an area two miles from the movie theater. The driver tried to take money from Bartl and refused to drive any farther. The driver then took Bartl to the intersection of Ogden and Kostner avenues and tried to attack him as he got out of the car. During the drive, Bartl had called the police twice. He waited at the street corner for the officers to respond to his call, but when Officers Gaspar and Duarte arrived, they drove to where the cab had pulled over, ignoring Bartl, who was waving at them. Bartl walked over to the officers and said, “I called you, this cab driver attacked me.” The officers told Bartl to give them his bag and put his arms up. The officers then searched Bartl without searching the cab, and Bartl once again tried to explain the situation. When Bartl asked the officers to arrest the cab driver for detaining and assaulting him, one of them told Bartl he needed to pay the driver a fare. Bartl explained that the driver did not take him to his destination, and Duarte told Bartl he'd be arrested if he did not pay the driver. Bartl pulled out a $20 bill, and Gaspar demanded that Bartl pay the driver. Gaspar then handcuffed Bartl and took him to a police station, where Bartl was locked in a cell for six hours. Bartl was released and charged with misdemeanor theft of labor/services, but the charges were dismissed one month later.
