Case 12-CV-2270

$64,000

EXCESSIVE FORCE/SERIOUS

Off duty Witness manipulation Excessive force False arrest or report Gun Other charges filed

Plaintiff: Mark Holda

Incident date: 04/26/2011

Location: 1535 W. Madison St.

Allegations:

Mark Holda, Joseph Holda, and Gorski were at the Billy Goat Tavern and Grill when Mark Holda and Officer Wyman got into a verbal argument. Wyman attacked Mark Holda and drew his gun during the fight. The police were called and Officers Corbett and Fowler arrived with other officers. Wyman and Corbett then went outside, behind the building, to talk about the incident. The Corbett spoke with Mark Holda outside the front door of the tavern. Holda told Corbett that Wyman had assaulted him and that the bar's video cameras had captured the attack. Corbett went back inside, then returned shortly after, falsely said he had seen the video, and placed Holda under arrest. Corbett and Wyman then went back to the entrance of the tavern and continued talking. At that point, Joseph Holda and Gorski began filming the two officers. Corbett got angry and arrested Gorski and Joseph Holda, with Officer Fowler helping him. Corbett then spoke with an employee of the Billy Goat, and coerced him to sign complaints against Mark Holda, Joseph Holda, and Gorski even though they had not commited a crime.
