Case 12-CV-1557

$59,301

FALSE ARREST

Home invasion Destroy/conceal/fabricate evidence False arrest or report Drug charges Weapons charges Other charges filed

Plaintiff: Julian Dailey

Incident date: 10/02/2009

Location: 4832 W. 51st St.

Allegations:

Officers Amato and Rivera arrested Dailey and charged him with unlawful use of a weapon by a felon, possession of a controlled substance with intent to sell and other offenses. Officer Amato testified before a grand jury that the evidence against Dailey was obtained through a search of a residence in the Garfield Ridge neighborhood, and that Dailey consented to the search. The grand jury indicted Dailey on the basis of this testimony. The officers, however, knew that Dailey did not live at that address. It was later discovered that Dailey's signature was forged by another person on the consent form, and all charges against Dailey were dropped.
