Case 11-CV-7450

$75,000

EXCESSIVE FORCE

Threats/intimidation Excessive force False arrest or report Physical force Hospitalized

Plaintiff: Leroy McCambry

Incident date: 10/21/2009

Location: 4700 S. Calumet Ave.

Allegations:

After McCambry took a purse from a vehicle, Officer Bailey pursued him. McCambry was on foot; Bailey was in a marked police vehicle. At East 47th Street and South Calumet Avenue, Bailey overtook McCambry. He drove onto the sidewalk, striking and injuring him. When Bailey got out of the vehicle, McCambry told him his hip was broken and that he needed to be taken to a hospital. Bailey ignored his pleas, yelled at McCambry and beat him. Bailey then dragged him eight feet to the squad car. Officers Leano and Nichols arrived and drove McCambry to the police station. McCambry continued to request care; the officers told him to “shut up.” When McCambry arrived at the police station, he could not walk. Nichols and Leano dragged him into the station and handcuffed him to the wall. McCambry told Officer Watts he was in extreme pain and that he needed medical care. Watts told McCambry to shut up and that he could not go to the hospital. He threatened to put a gun case on him if he was allowed to go to the hospital. After several hours in custody and without medical treatment, McCambry was taken to the hospital, where he was diagnosed with multiple fractures. The following month, Nichols falsely testified that McCambry was injured when he fell between a fence and the squad car.
