Case 11-CV-7067

$100,000

FALSE ARREST

On duty Later charged Destroy/conceal/fabricate evidence False arrest or report Gun Assault or battery to an officer charges

Plaintiff: Debra Green

Incident date: 03/19/2010

Location: 10112 S. Vincennes Ave.

Allegations:

After the funeral of Green's sister, the mourners drove from the funeral home to the cemetery with their cars bearing bright stickers that read “FUNERAL.” Fisher drove Green, and Jones drove separately. As the cars headed west on 79th Street and turned left to go south on Vincennes Avenue, Officer London, who was in uniform but driving her personal vehicle, cut through the procession. Green pointed to the sticker on the windshield and raised her voice at London as she and Fisher continued onto Vincennes Avenue. London followed and called 911 to report she was in distress. Near West 100th Place and South Vincennes Avenue, a group of officers, including London and Officer Williams, pulled over Green, Fisher and Jones. The officers pointed their guns at them and yelled “Put your f**king hands in the air.” The officers handcuffed Green, Fisher and Jones and searched them and their cars for at least 45 minutes while London accused Green of battery. The officers took Fisher's identification, and Green missed her sister's burial. The officers returned to a police station and falsified reports claiming Green had hit London with a bottle. Meanwhile, when Fisher went to the same station to retrieve his identification, London and others placed him in handcuffs and locked him up until the next day. Green called the Independent Police Review Authority to report the incident, and an investigator told Green he would obtain the Police Observation Device camera recordings of the incident. The police did not provide the recordings before the trial. Under oath, London stated that Green threw a bottle at her and hit her in the face. The charges against Fisher and Jones were dropped, but the judge found Green guilty of battery. After Green was convicted, the police released the camera recordings. The recordings showed that the charges against Green were false and London had lied on the witness stand. London was found guilty for falsely testifying, and Green's battery conviction was vacated.
