Case 11-CV-3957

$100,000

FALSE ARREST

Home invasion On duty Later charged Sexual harassment/abuse False arrest or report Physical force

Plaintiff: Rebecca Roe

Incident date: 03/11/2011

Location: 3455 N. Clark St.

Allegations:

Officers Clavijo and Vasquez were sitting in a police truck when they stopped Roe and offered her a ride to work. Roe accepted and got into the truck. When they were nearing her place of employment and Roe asked to get out, the officers insisted on taking her home instead. At Roe's home, the officers asked to enter the house to use the restroom. When Roe let them inside, Clavijo and Vasquez forced Roe into her bedroom where, without her consent, Clavijo removed her clothing. With encouragement from Vasquez, Clavijo raped Roe. After the rape, Roe called the police, and Clavijo was ultimately charged with criminal sexual assault. Both officers were also charged with criminal sexual assault in connection with allegations of another similar rape of a 22-year-old woman three weeks later. They both pleaded guilty to official misconduct in that case, avoiding prison time.
