Allegations:
Giles was at a gas station on South Halsted Street in Calumet Park buying gas for a car he had borrowed from his girlfriend's daughter when Officers Zavala and Newman arrived in an unmarked police vehicle. The officers got out with their guns drawn and instructed Giles, who was inside the vehicle, to “Show them hands,” which he did. Newman approached the driver's side door while Zavala approached the passenger side door. Newman grabbed Giles, who was still wearing a seatbelt, by his neck and T-shirt and attempted to drag him out of the car, while Zavala attempted to push him out from the passenger side. While Giles was hanging partially out of the car, his right hand fell back on the steering wheel. Zavala struck it with a blunt object, breaking the hand instantly. The officers handcuffed Giles, placed him in the back of a squad car and searched his vehicle. They didn't find contraband inside the car. At the station, Newman told Giles he had found a gun and drugs in the car. Even though Giles' swollen, broken hand was in obvious need of medical attention, the officers placed Giles in lockup. While in lockup, Giles told Officer Murrah that he was in pain and needed medical attention. Murrah told him to shut up, used him in a lineup and threatened to strip him. Twenty-seven hours after his arrest, Giles was taken to the hospital for treatment of his broken hand. He was later taken to Cook County Jail, where he was detained for a week. All charges against Giles were dropped.
