Allegations:
Alvarado was sitting in his car, parked in the driveway of his home when one of the officers hit the side of his head through an open window. The officers dragged him out of the car. One of them punched Alvarado, then handcuffed him and threw him to the ground. While he was on the ground, the officers kicked him several times. Officers took Alvarado to a hospital and then to the police station. At the station, Alverado was charged with driving under the influence, aggravated battery of a peace officer and various traffic violations. During the jury trial and a later bench trial, the Officers Garcia and Cabreles falsely testified against Alvarado. He was found not guilty of both counts of aggravated battery, negligent driving and DUI.
