Allegations:

Perry was in his home's vestibule talking with Kelvin Banks about buying a puppy from him. Perry and Banks were unaware officers had set up surveillance devices in the vestibule and were listening to their conversation. When Perry asked Banks if he could look at the puppies Officers Lenski and Weatherly, both wearing civilian clothes, entered the vestibule. Officer Weatherly pretended to be drunk or high before he grabbed and threw Perry to the floor and started choking him. Perry defended himself and managed to break free and leave the building. Running into the street Perry called his wife for help, hoping she or someone else would see he was being attacked. At this point officers had not identified themselves as police and Perry thought two random men were beating him up for no reason. Officer Weatherly followed Perry out side, jumped on his back and yelled, "Spit that shit up." Officers Lenski and Weatherly kicked Perry while he was on the ground a few times before handcuffing him and putting him in an unmarked police car. It was only then the officers identified themselves as police and told Perry he matched a description they were given of someone selling crack cocaine. After identifying themselves the officers threatened Perry with rape, calling him "bitch" repeatedly and saying he would become Officer Weatherly's "girlfriend." At the police station officers filed criminal charges against Perry and denied his repeated requests for medical treatment. These charges were later dismissed. Perry's injuries included a fractured elbow and bruising on parts of his body.
