Case 10-CV-4945

$34,576

EXCESSIVE FORCE/SERIOUS

On duty Excessive force Retaliation False arrest or report Physical force Nightstick Resisting or obstructing arrest charges

Plaintiff: Kevin Brady

Incident date: 08/11/2009

Location: 1752 N. Leavitt St.

Allegations:

Brady, 52, was standing on the sidewalk when he saw Officers Vega and Kieduk harass and use batons on two homeless men on the street for no apparent reason. Brady, who was also homeless and had stayed in various Chicago shelters, begged the officers to stop harassing the men. Vega and Kieduk responded by handcuffing Brady to a metal fence and striking him with their batons. They beat Brady and caused cuts and bruises all over his body as well as a fracture in his left leg. Brady was taken to a police station, where he was falsely charged with resisting an officer, and put in jail. Nearly a year later, the charge against him was dismissed with leave to reinstate.
