Case 10-CV-4049

$15,000

EXCESSIVE FORCE/SERIOUS

Home invasion On duty Pregnant Excessive force False arrest or report Physical force Gun Weapons charges Resisting or obstructing arrest charges Hospitalized

Plaintiff: Rachia Pickett

Incident date: 11/26/2009

Location: 7442 S. Wentworth Ave.

Allegations:

On Thanksgiving Day, Officers Tucker and Greene responded to a call about a man with a gun. When the officers arrived, they entered the residence without a warrant and seized Pickett and her purse. The officers hit Pickett's face, slammed her to the floor and knelt on top of her stomach and arms. Pickett and other people at the residence yelled to the officers that she was five months pregnant and begged them to stop. While Tucker knelt on Pickett's stomach, Pickett felt a rush of liquid exit her body vaginally. The officers claimed to have found a gun in Pickett's purse, and arrested her for having the gun and for resisting arrest. Pickett had never seen the gun that police allegedly found in her purse. She repeatedly asked the officers to take her to a hospital, but instead they took her to a police station. At the station, Pickett discovered she was bleeding vaginally. Eventually she was taken to a hospital, but continued to bleed for several days after her arrest. She spent one month in jail before her bond was reduced. At trial, Pickett was found not guilty of all charges.
