Case 10-CV-2463

$9,600

ILLEGAL SEARCH/SEIZURE

Home invasion On duty Damage to property Illegal search/seizure Gun

Plaintiff: Travis Robertson

Incident date: 01/19/2010

Location: 8115 S. Ashland Ave.

Allegations:

Robertson and Martin were in their first-floor apartment around 4 p.m. when several police officers broke down their door and entered. Two officers pointed guns at Robertson and Martin, and one handcuffed Robertson, who asked why they were there and if they had a search warrant. The officers told Robertson to shut up, and searched the apartment for about 30 minutes. The officers searched every room, flipping over furniture and looking through clothing, garbage cans and even a baby stroller without finding any contraband. Robertson asked once again to see a warrant, and an officer showed Robertson a warrant listing a second-floor apartment in the same building and an individual who lived there. Robertson told the officers where the person on the warrant lived and asked for a copy of the warrant. The officers left without giving him a copy and entered another first-floor apartment. After the incident, Robertson filed a complaint with the Independent Police Review Authority.
