Allegations:
In December 2008, Betts was arrested by several police officers, who repeatedly hit him in the head with a gun, used pepper spray on him multiple times, threw him to the ground, kicked him and poured dirty mop bucket water onto his head. At no time did Betts resist arrest or pose any threat to the officers. The officers repeatedly asked Betts where a gun and drugs were located, and told him they hoped he would die. They told Betts he would go to jail unless he gave them useful information. Betts insisted he did not know anything about guns or drugs, and that he “just beat the case," referring to criminal charges against him that had recently been dismissed. The officers replied, “We know that.” Betts asked the officers for water, and they poured boric acid in a cup of water and offered it to Betts. Though Betts asked for medical attention, the officers refused. He was eventually taken to a hospital by other officers who saw his injuries at a police station.
