Case 09-CV-4993

$5,000

EXCESSIVE FORCE/MINOR

Home invasion On duty Minor Damage to property Excessive force

Plaintiff: Carolyn Richardson

Incident date: 07/18/2009

Location: 4635 S. Whipple St.

Allegations:

Richardson was at home with her children and husband in their living room when they heard a neighbor's dog howling. J.R., one of Richardson's children, went to open the door and see what was going on. As J.R. began opening the door, several police officers shoved open the door and entered the apartment. One of the officers went into a bedroom and seized L.R., Richardson's son, from his bed. The officer brought L.R. to the living room and told the family they could not leave that room. The officers searched the apartment without finding any contraband or evidence of criminal activity. Richardson called 911 and reported that police officers were searching her home. She asked for a sergeant to come and control the situation. Richardson asked the officers if they had a search warrant; one officer replied that they did not need a warrant. As a result of the search, the officers damaged Richardson's property.
