Case 09-CV-4857

$50,000

ILLEGAL SEARCH/SEIZURE

Home invasion Damage to property Retaliation Threats/intimidation Illegal search/seizure Drug charges

Plaintiff: O'Neal Johnson

Incident date: 12/02/2008

Location: 4207 S. Princeton

Allegations:

Police retaliated against Johnson for filing a misconduct lawsuit against their fellow officers in addition to multiple misconduct complaints with the Bureau of Professional Standards and the Independent Police Review Authority. In December 2008, after Johnson received a $65,000 settlement in a lawsuit, Officers Kemps and Cahill arrested him outside his home, took his house keys and ransacked his home. Johnson was later told that he was being charged with criminal possession of cananbis, which police fabricated. The charge was dismissed. In August 2009, Johnson sued Kemps and Cahill for false arrest. A month later, officers in Halloween masks, including Officers Kerr and Alonso, raided Johnson's home, claiming they were looking for a gun. They didn't find a gun, but the officers falsely charged Johnson with possession of crack cocaine. The charge was also dismissed.
