Allegations:
Giles was driving his cousin, Oscar Salgado, and a friend when he saw a beige Chevrolet make a sharp U-turn and begin following his car. Officer Johnson, who was driving the unmarked car, continued to pursue Giles' car at high speed and eventually placed a rotating light on the roof of his car. Giles feared that the driver of the car chasing him was not really a police officer, and that he and his friends would be robbed or attacked if he stopped. Johnson continued to chase Giles at a dangerously high speed that led to a car accident, killing Salgado and seriously injuring Giles. Several police officers arrived at the scene and, despite Giles' injuries, threw him to the ground, put him in handcuffs and kneed him in the back. When Giles tried to explain he was injured and in pain, an officer responded, “I'm going to ship your ass back to Mexico.” He also threatened to “plant something” on Giles. Another officer slammed Giles' head onto the sidewalk. Later, Giles was taken to a hospital, where he was diagnosed with a fractured spinal cord. He also suffered bruising on his right shoulder, injuries to the back of his head and knees, and a deep, open wound on his left leg.
