Plaintiff:
Sylwia Marcinczyk
Incident date:
04/01/2007
Location:
5600 W. Belmont Ave.
Allegations:
Marcinczyk worked at Complete Care, Inc., a short-term care and hospice agency, and had a divorce pending with Bogdan Mazur. Mazur wanted to gain control of Marcinczyk's business and custody of his two children with her. To this end, Mazur planted a gun and drugs in his wife's vehicle and conspired with Officer Plewa to get Marcinczyk arrested. Plewa stopped Marcinczyk's vehicle and arrested her for weapon and drug felonies. Officers had no warrant to search her vehicle when she was pulled over; they relied on an anonymous "confidential source" that did not exist. Marcinczyk was held in Cook County Jail and then a federal detention center for 12 days. Marcinczyk's children were not allowed to visit her for at least 30 days. Police also impounded Marcinczyk's vehicle. She was later found not guilty of criminal charges. An investigation later conducted by the Cook County State's Attorney's office led to the arrest of Mazur and Plewa.
