Allegations:
Aguero went to a police station to report that his license plates had been stolen from his car. Aguero explained this to Officer Schanelli, who turned to Officer Walker and asked, “What do we do?” Walker asked Aguero if he had any traffic tickets, and Aguero said he did. Walker asked Aguero how he knew the plates had been stolen, and Aguero explained that the screws had been removed and his plates were gone. Walker replied, “You know you ain't getting out of paying for your tickets.” Aguero said that was not his intention. Walker repeated that Aguero needed to pay his tickets, and that he was not fooled by Aguero's “Latin King gang banging bulls**t.” Aguero is not a member of the Latin King gang. Aguero asked for Walker's badge number, and Walker refused to provide it. Aguero then asked Walker and Schanelli if they were going to help him retrieve his stolen plates, and they replied no. As Aguero exited the station, Walker followed him and approached Aguero's car. Walker then ordered Schanelli and an unnamed officer to arrest Aguero. Schanelli grabbed Aguero by the arm, and the other officer kneed Aguero in the abdomen and face. Schanelli slammed Aguero to the ground and handcuffed him. They took Aguero back to the station while Walker threatened to write Aguero additional tickets. Walker took Aguero by the neck, walked him to a room and began choking him and punching him in the face and stomach. Aguero repeatedly asked for legal representation and medical care; both were denied. The unnamed officer told Aguero, “Don't be such a big pussy,” and the officers falsely arrested Aguero for battery. Aguero wrote at least two letters about the incident to the Office of Professional Standards but did not receive a reply.
