Case 08-CV-5944

$20,000

MALICIOUS PROSECUTION

Forced confession False arrest or report Other charges filed

Plaintiff: Frank Davis

Incident date: 10/25/2005

Allegations:

Davis was driving with some friends, including Curtis Clark and Dewayne Lucas, in the Rogers Park neighborhood on Nov. 18, 2003. On that same day, two persons were murdered in the neighborhood; Clark, Lucas and another person riding with Davis were implicated in the murder. Initially, Davis was not implicated. In 2005, he was arrested while in Macon County, Illinois and placed in holding until Detectives Yawger and Zacharias spoke to him. The visit coincided with the criminal trials of Clark and another individual, Owen Payne, for the 2003 murders. The detectives tried to coerce Davis to testify against these two individuals. When he refused, Detectives Yawger, Zacharias and Villardita took Davis back to Chicago and alco charged him with the murders. Clark and Payne, under coercion, fabricated statements that implicated Davis. As a result, he spent two years in jail until he was found not guilty in 2007.
