Allegations:
Alston, who was unarmed, was approached by Officers Devries, Stoll and Peblanski on the street before Stoll shot him in the midsection. To cover up the incident, the officers agreed to arrest Alston for disarming an officer and aggravated assault of an officer. The officers filed reports claiming Alston grabbed Devries' weapon, even though DNA testing later revealed only Devries' DNA on his gun. Unable to make bail, Alston was in jail for more than two years. He had multiple surgeries for the gunshot wound, and at one point had to wear a colostomy bag. He was released after a judge reduced his bail. Nearly a year later, a jury found Alston not guilty of both charges. As a result of his injury, Alston has incurred hundreds of thousands of dollars in medical bills.
