Plaintiff:
Donyell Mayhew
Incident date:
09/27/2006
Location:
209 N. Kolmar Ave.
Allegations:
Mayhew was allegedly involved in a robbery of Officer Gutierrez. After the alleged incident, Mayhew was in an apartment bathroom when police officers entered the apartment. Officer Dolan came into the bathroom with his gun drawn. Dolan ordered Mayhew to get on the floor and put his hands behind his head. Mayhew complied. Dolan kicked Mayhew in the head and handcuffed him, while another officer entered the bathroom and also kicked Mayhew in the head. Dolan stood Mayhew up and punched him in the face. Gutierrez entered the bathroom and asked Mayhew, “Remember me? Remember me, m***** f*****?” Gutierrez punched Mayhew so hard he fell to the floor. Dolan lifted Mayhew up by the throat and held him off the ground while the other officers punched Mayhew in the face and stomach. Dolan let Mayhew go, and Mayhew crumpled to the floor before Dolan struck Mayhew with the butt of a gun. Dolan then wiped off Mayhew's bloody face with a towel. The officers took Mayhew to a police station, where they removed his bloody shirt and told him to put on a different one. The officers took Mayhew to a different police station, where they were ordered to get Mayhew medical treatment. They took Mayhew to a hospital, where he was given medication and his wounds were bandaged. Gutierrez and Dolan filed reports against Mayhew for armed robbery and battery. The next day Mayhew was taken to Cook County Jail. One month later, Mayhew filed a complaint with the Police Department's Office of Professional Standards, but the office has not taken any action.
