Cook and the Gersloki family were watching television in Cook's living room one evening around 10 p.m. when Officer Przbylo knocked on the front door. When Cook answered, Przbylo and several other officers, including Officers Finnigan, Fuelling and Burg, pushed open the door. One of them drew a gun. The officers said they had come to search his house over illicit drug dealing. Cook, who was a fireman in the Chicago Fire Department, asked to see a warrant. The officers entered the home and handcuffed Cook, who was recovering from surgery. The officers then shoved Cook against a wall. Cook asked to call 911, but Finnigan and Fuelling threw Cook to the ground and repeatedly slapped him in the head. They grabbed Cook by the head and bent it. The officers told Cook they had watched him for the past three months as Cook had made drug deals on his motorcycle. Cook told the officers he had broken his neck years ago and had stopped riding motorcycles. When Cook asked Denine Gersloki to call 911, the officers threatened to handcuff and abuse her.
